संविधान दिवस 2021:जानें किस प्रकार हुआ भारतीय संविधान सभा का निर्माण

देश में जब भी कोई संकट आता है या राजनीतिक विवाद होते हैं, तब-तब संविधान का ही हवाला देकर उस विवाद और संकट को हल करने की बात की जाती है। आजादी के 75वें साल में आते-आते और अपने लागू होने की 71वीं सालगिरह तक अपने देश में संविधान किसी धर्मग्रंथ से भी ज्यादा पूजनीय और पवित्र बन चुका है। लेकिन इसके निर्माण से जुड़े कई ऐसे तथ्य हैं, जिसे बहुत कम ही लोग जानते हैं।

जिस संविधान सभा ने संविधान तैयार किया, एक दौर तक उसका विरोध वामपंथी विचारधारा करती रही। उनका तर्क था कि संविधान सभा के सभी 389 सदस्यों का चुनाव तो हुआ था, लेकिन उनका निर्वाचन प्रत्यक्ष नहीं था। यानी जिस जनता के लिए वह सभा संविधान का निर्माण करने वाली थी, उसका निर्वाचन उस जनता ने नहीं किया था।

दरअसल संविधान सभा के सभी सदस्यों को या तो तब के अंग्रेज शासित राज्यों के विधान मंडलों और रियासतों के सीमित मतदाता वर्ग ने चुना था। संविधान सभा के कई सदस्य बेशक भारत की आजादी के आंदोलन के सेनानी रहे थे, लेकिन जिस प्रारूप समिति ने इसे तैयार किया, उसका कोई सदस्य आजादी के आंदोलन में शामिल ही नहीं था। संविधान सभा की प्रारूप समिति के सातों सदस्यों में से एक कन्हैया लाल मणिक लाल मुंशी स्वाधीनता सेनानी तो थे, लेकिन भारत की आजादी के लिए हुई निर्णायक जंग यानी भारत छोड़ो के वक्त वे चुप थे।

आजाद भारत के पहले भारतीय गवर्नर जनरल चक्रवर्ती राजगोपालाचारी भी भारत छोड़ो आंदोलन के दौरान चुप रहे। बाबा साहब भीमराव आंबेडकर इस प्रारूप समिति के अध्यक्ष थे। लेकिन वे भारत छोड़ो आंदोलन के दौरान ब्रिटिश वायसराय की काउंसिल के सदस्य थे। यानी आजादी के आंदोलन में उनकी सीधी भागीदारी नहीं थी, बल्कि उस दौरान वह ब्रिटिश सरकार के मंत्री की हैसियत से काम कर रहे थे। संविधान सभा का गठन छह दिसंबर 1946 को हुआ था। इसके तहत संविधान निर्माण की समिति बनी, जिसे ड्राफ्ट कमेटी भी कहा जाता है। उसके जिम्मे संविधान के तब तक तैयार संविधान के प्रारूप पर बहस करके उसे 389 सदस्यीय संविधान सभा में प्रस्तुत करना था, जो उसे अंतिम रूप देगी।

देश के भावी सरकार के लिए तत्कालीन अंतरिम सरकार के प्रधानमंत्री जवाहरलाल नेहरू और उप-प्रधानमंत्री सरदार पटेल ने कर्नाटक के जाने माने विधिवेत्ता बेनेगल नरसिम्ह राव को विधि सलाहकार का पद देकर संविधान के प्रारूप पर काम करने के लिए 1946 में ही जिम्मेदारी दे दी थी। बीएन राव ने मद्रास और कैंब्रिज विश्वविद्यालय से पढ़ाई की थी। वर्ष 1910 में वे भारतीय सिविल सेवा के लिए चुने गए। वर्ष 1939 में उन्हें कलकत्ता हाई कोर्ट का न्यायाधीश बनाया गया। जम्मू-कश्मीर के महाराजा हरि सिंह ने 1944 में उन्हें अपना प्रधानमंत्री नियुक्त किया था। इन्हीं राव साहब को संविधान का मूल प्रारूप तैयार करने की जिम्मेदारी दी गई थी। भारत सरकार के संविधान सलाहकार के नाते उन्होंने वर्ष 1945 से 1948 तक अमेरिका, कनाडा, ब्रिटेन आदि देशों की यात्र की और तमाम देशों के संविधानों का अध्ययन किया। इसके बाद उन्होंने 395 अनुच्छेद वाले संविधान का पहला प्रारूप तैयार करके संविधान की प्रारूप समिति के अध्यक्ष डा. आंबेडकर को सौंप दिया।

29 अगस्त 1947 को प्रारूप समिति की बैठक में कहा गया कि संविधान सलाहकार बीएन राव द्वारा तैयार प्रारूप पर विचार कर उसे संविधान सभा में पारित करने हेतु प्रेषित किया जाए। संविधान सभा में संविधान का अंतिम प्रारूप प्रस्तुत करते हुए 26 नवंबर 1949 को भीमराव आंबेडकर ने जो भाषण दिया था, उसमें उन्होंने संविधान निर्माण का श्रेय बीएन राव को भी दिया है।

संविधान सभा की प्रारूप समिति के अध्यक्ष आंबेडकर थे। उसके दूसरे सदस्य थे अल्लादि कृष्णास्वामी अय्यर, जो मद्रास प्रांत के महाधिवक्ता रहे। इसके तीसरे सदस्य थे, कन्हैया लाल मणिक लाल मुंशी। मुंशी की ख्याति गुजराती और हिंदी लेखक के साथ ही जाने-माने वकील के रूप में भी रही है। मुंशी ने भी 1942 के भारत छोड़ो आंदोलन में हिस्सा नहीं लिया था। तब उनका मानना था कि गृह युद्ध के जरिये भारत अखंड रह सकता है। वे पाकिस्तान के निर्माण के विरोध में इसी विचार को सहयोगी पाते थे। इसके चौथे सदस्य थे, असम के मोहम्मद सादुल्ला। वैसे तो उन्होंने मुस्लिम लीग के साथ राजनीति की, लेकिन वे भारत में ही रहे। पांचवें सदस्य थे आंध्र प्रदेश के मछलीपत्तनम निवासी एन माधवराव, जो मैसूर राज्य के दीवान यानी प्रधान मंत्री भी रहे। वे तेलुगूभाषी थे और दिलचस्प है कि हिंदी को राष्ट्रभाषा बनाने के विरोधी रहे। छठे सदस्य को लोग नेहरू सरकार में वित्त मंत्री रहे टीटी कृष्णमाचारी के रूप में जानते हैं। सातवें सदस्य एन गोपालास्वामी अयंगर थे। वे बीएन राव से पहले कश्मीर के प्रधान मंत्री रहे।

संविधान सभा ने जब 26 नवंबर 1949 को संविधान को अंगीकृत किया तो इसके सभी सदस्यों ने उस पर हस्ताक्षर किए थे, सिवाय उन्नाव निवासी क्रांतिकारी शायर और संविधान सभा के सदस्य हसरत मोहानी के। उन्हें जवाहरलाल नेहरू ने मनाने की खूब कोशिश की थी, लेकिन वे अडिग रहे। दरअसल वे भारत को राष्ट्रमंडल का अंग बनाए जाने के विरोधी थे।
